Delhi High Court Eases Rare Disease Treatment: Customs Duty Exemption

In a verdict, the Delhi High Court has taken steps to ease the burden linked to treating rare diseases. The focus is on reducing customs duties and charges on medications and therapies. Justice Pratibha Singh, who presided over the case, stressed that drugs and therapies meant for rare diseases should not be subject to customs duties. The court also instructed customs officials to ensure clearance of medical supplies without unnecessary delays so they could promptly reach the designated hospitals.
Justice Pratibha Singh specifically mentioned a notification issued by the Finance Ministry in March of this year. This notification provided exemption from customs duty on all drugs and specialized food imported for personal use in treating rare diseases listed under the National Policy for Rare Diseases 2021. This exemption was introduced through notification to improve access to medical resources for individuals dealing with rare conditions.
The decision of the Delhi High Court was made in response to petitions representing more than 100 children affected by rare diseases like Duchenne Muscular Dystrophy and Hunter syndrome. These children sought access to treatment acknowledging the financial obstacles posed by their conditions.
The court’s proactive approach shows a dedication to guaranteeing healthcare opportunities for individuals affected by illnesses. The court has instructed its office to deliver the directive to the Central Board of Indirect Taxes and Customs for immediate implementation emphasizing the critical importance of offering essential medical resources to those requiring assistance
