The Delhi High Court has instructed Lok Nayak Hospital to provide immediate medical treatment to an HIV-positive transwoman, even though she lacks identity documents. Justice Sanjeev Narula, who issued the directive, also sought the Delhi government and the Centre’s responses to her plea, emphasizing the need for her rehabilitation and shelter.

The petitioner revealed that she was abducted as a minor by a trafficker and subjected to sexual abuse. Following this, doctors at Lok Nayak Hospital recommended her admission for treatment. However, her lack of official identification hindered her access to healthcare and shelter facilities.

Court Order

Acknowledging the urgency of her situation, the court stated, “Lok Nayak Hospital must examine and treat the petitioner immediately, regardless of her absence of identity proof.” The order, dated December 24, highlights the need for humane intervention, especially during Delhi’s harsh winter.

In addition to ensuring medical care, the court directed the Centre to explore options for skill training to aid her rehabilitation. Furthermore, authorities were tasked with identifying a suitable shelter for the petitioner that would accommodate her health needs and protect her from the severe cold.

The transwoman’s plight reflects a broader issue of systemic challenges faced by marginalized communities, particularly when they lack documentation. She had approached multiple NGOs seeking shelter but was turned away due to her inability to provide identity proof.
